Terms.
In consideration of the services provided by Truss Components of Washington (“TCW”) and the money amounts provided herein, the TERMS OF THIS AGREEMENT will be as follows:
1. Purchaser shall note any changes or plan deviations in writing, which may incur further costs to Client.
2. If trusses are delivered:
a. Purchaser verifies adequate access to make delivery without danger to personnel, property or equipment.
b. Contractor shall aid in unloading and landing trusses. Unless other arrangements are made, contractor shall provide third-party-qualified signal person to assist in offloading of trusses.
c. Purchaser agrees to pay for tow truck if necessary.
d. Purchaser agrees that TCW shall be held harmless for any damage that occurs to above job site as a direct or indirect result of TCW delivering product to or performing work at above job site.
e. Price includes off-loading of trusses in bundles. On-site time exceeding the amount included in the agreement will be charged at a rate of $250.00 per hour for truck and operator.
f. TCW-supplied-qualified signal person will be billed at $75.00 per hour on site plus $2.00 per mile one way for travel.
g. Truss Components will make every effort to deliver on the contractor's schedule, but does not guarantee a date or time of delivery.
3. If customer picks product up, pricing is F.O.B. TCW yard.
4. Payment terms:
a. Prepay with order except on approved credit.
b. Terms on approved credit, unless noted otherwise, are as follows:
i. Payment in full due within 30 days of delivery.
ii. 18% per annum interest accrues if payment is not made in full after 30 days of delivery.
iii. Purchaser shall be responsible for all costs of collection, legal, and attorney fees.
iv. Governing law is Washington law and venue is Thurston County, WA. TCW reserves the right to file liens as per WA State Law.
5. TCW guarantees materials and workmanship for 1 year from date of delivery when components are properly installed. If factory error is discovered, the customer must contact TCW immediately. No modifications of components shall be made prior to allowing TCW to correct the problem, thus maintaining the warranty.
Components are designed and fabricated to meet engineering and profile requirements, not cosmetic appearance. Wood members may be discolored, dirty, painted or otherwise blemished due to natural or fabrication processes.
